These Terms and Conditions (“Terms”) govern all rentals made through DMV Scaffold Rentals (“Company”, “we”, “us”). By placing an order on our website, by phone, or in person, the customer (“Client”, “you”) agrees to be bound by these Terms.
By submitting payment for any order, you understand and agree that you are **not** purchasing the scaffold, ladder, or any other equipment; you are only paying for a temporary, limited right to use the equipment for the rental period selected during checkout or agreed in writing. Title and ownership of all equipment always remains with the Company.
All online orders are considered rental **requests** only. After you place an order, we will contact you by phone, text, or email to review availability, confirm pricing, verify your information, and process the order. Your rental is not confirmed until we send a written confirmation. Most scaffold reservations can be picked up the same day in Damascus, MD, subject to availability and our confirmation. Orders received after 2:00 p.m. Eastern Time will be processed for pickup or delivery on the next business day, unless we expressly agree otherwise.
To rent scaffolding or any other equipment from us, you must present a valid, unexpired government‑issued driver’s license or local ID at the time of pickup or delivery. No exceptions will be made. You also agree to sign our rental contract and any additional forms required, including but not limited to payment authorization and safety acknowledgment forms. By signing the rental contract, you agree to return all equipment in the same condition in which it was received (normal wear and tear excepted) on or before the agreed return date and time. Failure to return equipment on time may result in additional rental charges, late fees, and, if necessary, recovery costs.
You are fully responsible for the safe transport, handling, assembly, use, and disassembly of all rented equipment once it leaves our possession. We do not supervise or control the way scaffolding or other equipment is installed or used at your job site. You agree that any assembly, configuration, or modification of the equipment performed by you, your employees, subcontractors, or any third party is done at your own risk. We are not responsible for, and assume no liability for, any injury, accident, property damage, or loss arising out of or related to the use, misuse, improper installation, alteration, or overloading of the equipment, even if you received general guidance or information from us.
The Client agrees to inspect all equipment at the time of pickup or delivery and to notify us immediately of any visible damage, defect, or missing parts before using it. Once you take possession of the equipment, you accept it “as is” and acknowledge that it is in good working condition to the best of your knowledge. You agree to use the equipment only for its intended purpose and in compliance with all applicable laws, OSHA regulations, manufacturer instructions, and safety standards. You are solely responsible for ensuring that all users are properly trained and follow all safety procedures, including the use of fall protection and other required personal protective equipment.
In the event of loss, theft, or damage beyond normal wear and tear, you agree to pay the full repair or replacement cost, as determined by us in our reasonable discretion. We may charge such amounts to the payment method you provided and/or retain any deposit, in addition to charging extra rental days until the matter is resolved. By renting from us, you expressly authorize us to charge your card or account for unpaid rental fees, late fees, damage, and replacement costs as allowed by law and by the rental contract you sign.
To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose. In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or personal injury, arising out of or in connection with the rental, use, or inability to use the equipment, even if we have been advised of the possibility of such damages. Your sole remedy for any claim related to the equipment or these Terms is limited to the amount of rental fees actually paid for the specific rental at issue.
By proceeding with any rental, you acknowledge that you have read, understood, and agree to these Terms and Conditions, and that they apply in addition to, and together with, any written rental agreement or order confirmation provided by DMV Scaffold Rentals. If there is any conflict between these online Terms and a signed rental contract, the signed contract will control for that specific transaction.
